When it comes to the Visa Waiver program, clients often ask me, what happens when a Visa Waiver traveler who is in the U.S. visits a third, non-adjacent country, and then seeks to return to the U.S.? Do they receive a new 90-day period upon re-entering the United States? What if they go to Mexico or Canada or another adjacent country?
According to the CBP, An alien admitted into the United States under the Visa Waiver Program (VWP) who departs to visit a third country other than contiguous territory or an adjacent island and then returns to the United States to apply for admission as a temporary visitor for business or pleasure under the VWP, would receive a new 90-period of admission if he is found to be admissible.
If the same alien traveled only to foreign contiguous territory or an adjacent island, he would generally be readmitted for the balance of his original period of admission if found to be admissible. An alien is this situation may request to be admitted for a new 90-day period and be admitted for that new period if slbe is found to be admissible.
Please note that any VWP applicant for admission must establish his admissibility to the satisfaction of the inspecting CBP officers. An alien seeking a new 90-day period of admission under the VWP after departing the United States to "visit" a third country should expect to undergo greater scrutiny than most other VWP applicants. So this is possible but expect a tough time trying to get back in.

Hi,
My current visa status is H4. As i cannot work on this visa, I am interested in doing an Unpaid Internship. Please clarify whether I can do so on an H4 visa.
I'm trying to secure the internship in a nonprofit organisation. Will there be an exception for them, in case it's not allowed otherwise?

AFAIK, you can do volunteer work without restrictions, provided this truly is a volunteer work; i.e., there is no employer-employee relationship, and you are not working in anticipation that you will be hired in near future based on your current work.
Maybe a good test is, if the nonprofit organization requires your SSN before they would allow you to work, then you may not do that work on H4.

HR of my Company screwed up with the content of the EB2 Ad posted in sunday newspaper. To save money they posted a partial AD with a link to the job listing on the companys website saying "Please goto this link for further information".....
Would this be ok?
If the company is paying the lawyer for the process, you just relax. They must have consulted the lawer before giving the ad and get directions, because the lawyer has to send these evidences when filing.
If not, you better check with an expert.

Gurus,
Yesterday my lawyer received receipts for my spouse and kids (485/EAD/AP) but not for myself. Now my lawyer is insisting upon sending me the copies of the receipts and do not want to send me the originals. With respect to that I have following questions:
1) Is that o.k having copies only or we should have originals? If we do not
have originals what bad may happen?
2) Either my lawyer or I have not received any of my receipts but we
received all receipts of my family. Is this normal? How long should we wait
for my receipts before contacting USCIS? By the way USCIS already gave
me my all numbers for teh receipts and according to USCIS my receipts
already mailed on Sept 14th. What would be advisable action for me in
this case?
3) None of the receipts of my family contain Priority Date. PD field is blank on all receipts. Is this O.K.?

Is premium processing option available for the this change of status?
Friend worked till last week of pregnancy (clean H1 history before). Her 12 weeks of maternity leave is ending soon and looks like the family needs to pay attention to child's condition and she has no choice but to become a full-time mom (another full-time job in itself though). She was in status during her maternity leave (some part of which was covered by STD insurance, remaining unpaid leave totaling 12 weeks under FMLA). She needs to change her status from H1 to H4.
What are the timelines for I-539 Change of Status for H1 to H4?

how is it possible to change jobs while the GC application is pending (part of the July 07 madness). Supposedly there is the AC21 form, is there an example how this form should be filled, and what other documents should be included? How long does it take to approve? (for driver's license, traveling, etc.). Does it have to be filed with H1B extension?
The new job offer is 25% pay increase, otherwise very similar, could that be a problem?

If it is new 485 filing then you don't have A#.
A# on I-140 is nothing do with your 485.
Its has everything to do with 485 if its the alien # alloted to you at 140 stage and begins with a 0 (zero) thats your permanent alient number wont change for life.
But as far as not mentioning it is no big deal as your paperwork includes I140 copy or original whatever and shouldnt have any negative impact on the filing.

I have read around here about some people sending in their applications earliert then the recommended 120 days and they all got receipts so don't anticipate any issues with that. As far as photo's are concerned you don't have to send any photos with your efiled Ead since you will be called for a finger printing and photo session but for AP you need to send pic's and don't forget to write your A# behind the photos. Hope this helps. Read the link below for more info on what you need to send for AP and for EAD you will get a list of doc's they require once you are done filing online.

1) So does it mean, if we apply for fresh h1 and once it's approved, we can stay for 3 years initially irrespective of L1 stay, for my case its' 13 months ? If not, how L1 stay affects initial h1 approval timings ?

I think TSC is strictly screening all applications so that it will not be burdened by too many cases including incomplete application to be processed. Therefore, in the long run, TSC will be faster in approving or denying cases.
