Hi Buddy,
Put your address in 485 apps. You may at some point want to change the employer under AC21 rule and this will allow you to 'carry' the 485 process with you. Basically you own 485 process whereas it's not the case with labor and I-140.

I have to agree that the back ground is a bit distracting, but the petal is a very cool shot. If this were my shot I would try a few things in Photoshop to change it up. Like maybe make the background black and try black and white? Something like that may add something to it. Just a thought. Don't give up on it there's something there it just has to be found-:)!!

no labor is position dependent not person dependent. You cannot make it go faster based on earlier 140.

If your company is regularly advertising and they have all the ad's in place as required by PERM , they can file your PERM and you can get your labor approval. If in case your labor is approved before 30th july you would be able to file concurrent 140 & 485 and can retain your PD too.

Is there any risk in rescheduling a fingerprinting appt? I am travelling when the appointment is currently scheduled for:(. Does that impact the overall processing times of 485/EAD/AP?
With an travel plans that you can attach asking for a later date for the FP. If possible give them the possible dates you will be arriving back and request a date after that. Make sure in your absense somebody is available to pick up your FP notice from the mailbox. Send your request as early as possible with a delivery confirmation and/or signature requried so you have a track of whether your letter made it to them in time just in case..

I saw strange messg on my I-485 while checking the status what does this mean.

Hi all!
I've been trying to get a job offer from Canada for the past one year as my occupation is not on the list of occupations that have shortage. I'm a market research analyst and work online with a UK company for almost 3 years. I would love to move to Canada and have a real job and family but am at a stage where I do not know what else to do as the companies want you to be present in Canada and Canadian govt asks for a job offer to get a visa?
Very confused here. If someone got an arranged offer from Canada could you please guide on how much work experience you had and how you got an offer?

I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.
I probably go ahead and use what in the approved labor certificate. by the way how do I find exact job-code that I used in the I-140.

If you have receipt # of your I-485, filing or refiling I-765 and I-131 is a simple task. You can do that after 30 days, as suggested by USCIS. It is not a big loss anyway. Main thing is I-485.

Hello,
My wife and I both work for the same company and my PD date is 1 year behind my wifes. But she was born in Germany though she is currently an Indian citizen. Now that the ROW category has moved passed her PD's date (Nov 6th 2002), we plan to file under the ROW category using the Cross Chargability rules. Does anybody have any experience filing under this rule? We have her birth certificate (translated into English from German etc) and our lawyers will send us the list of documents i expect. So basically i am trying to find out what to expect when filing under this category. Are there any caveats, good to knows etc?

My husband is currently employed on a H1 visa and I am on a H4 visa. Our current visas(H1 and H4) are valid till January 2013. We are Candadian permanent residents who plan on ultimately applying for green cards and settling down in the US. I am a newbie in this arena and have a few questions that I tried searching answers for but couldn't find anything conclusive and would appreciate any answers
1) For various reasons can I stay back in the country for 4-6 months, while my husband goes back to Canada on the extended unpaid leave for the 4-6 months and comes back? Or if I leave with him now, can I come back after 6 months and stay here for 4-6 months? Are there any rules/regulations that prevent me from doing this. Please note that we live across the border in Canada and travel back/forth via car.
2) My hubby is planning on taking an extended unpaid leave from work( for personal and not health related reasons) and his employer is OK with that. This could be as short as 3 months and could be as long as a year. During this time we will be going back to Canada. Do you know if this will create any issues with immigration currently or in the future? How long can this leave exist?
3) If my husband ultimately comes back to a different job after this unpaid leave, will his chances of getting a visa for that new job be affected?
4) If he wants to take an extended leave do we need to leave the country? Can we take an extended leave and stay in the country? Will we be violating any rules/regulations if we do that?

1.I applied for I-485 in May 07 and got I-485 reciept in June 07 , and returned to US in july 07 after a short travel outside US.
2.I got the new I-94 card
3.The purpose of my trip outside US to erase my previous out of status history for more than 180 days.
4.My question:How to send my latest I-94 copy to USCIS ? Do i need to attach any form along with latest I-94?
5.Will it really erase my previous out of status history , by considering the fact the I am always in legal status after my re-entry in US and USCIS having my latest I-94(once I send the latest I-94)
