    USCIS will only share information about the I-140 case with the applying employer and their lawyer. I once tried to help my employer to find out if the reply to an RFE on my H1-B had been received and they refused to tell me anything. I got a copy of the I-140 from the lawyer and the original from my employer, but as someone said it was a curtesy from the employer to share it.

    Its better than not going to work and sitting at home playing with your kids or watching movies or shopping at walmart or doing laundry etc etc mulling about your future if you have time to spare for a thought
    Who said the demonstrations have to be on weekday. You can very well do it on weekends and you can do it during your lunch breaks . What we lack is resolve not resources
    I hope everybody agrees with that

    Is someone working to fix the issues with the IV Tracker? It is such an important tool, but still has bugs to be resolved.

    When you try to restrict by country or Country of charge, it doesnt bring back any results.

    Also, if you try to sory by priority date, the sorting doesnt seem to work.

    Yes we are working on it and will be enhancing it. Please keep adding your details to it.

    The officer retains one of the original AP the first time. The other one that is handed over to you is stamped. So next time, you show the one that is stamped to enter and you will not have to give them any more copies.

    Now my experience may be different, but i believe there are some differences in the process.

    My AP Experience:
    No secondary check, i told officer that we are using AP. He said fine,
    took both copies , stamped with AOS stamp and gave back both copies.
    I donot think he made a copy for himself or even kept one original.

    I was worried about re-entry as my wife had status change and had not gone back home after status change; and then this 485 filing.
    But overall it was very sweet.

    I must say there were few others going thru AP process at Chicago with us, and no one had to go to another room for screening or Finger printing.
    My gut feeling is, we had our FP for 485 done earlier this year in US so they may not need another FP. The FP when using AP might be for people who have not gone thru FP for 485.

    my 2 cents,

    AP is easy no worries, as long as you have right papers ( AP ) you are good.
    We were not asked for anything other than AP.

    section says as UNKNOWN, called USCIS and she does not know any thing about it

    Attorneys or Gurus please:

    I have a bit different situation than Raj (rajivkane), so please suggest/answer following queries:

    1. Is it advisable to file amendment I-824 or other (requesting an amended approval notice with retention of earlier priority date) instead of filing a new EB2 I-140 once EB2 Labor will get clear? My 485 is pending with EB3 I-140, where as EB-3 I-140 got approved before filing I-485 in July'2007.

    2. Or it�s compulsory to file new I-140 with EB2 and once I-140 after that amendment.

    3. Will it impact my pending 485 in regards to any of the above cases, which ever is correct?

    This is one of the most hilarious thing I heard in months, thought I'll share....

    It was the first day of a school in USA and a new Indian student named Chandrasekhar Subramanian entered the fourth grade.

    The teacher said,

    She saw a sea of blank faces, except for Chandrasekhar, who had his hand up: 'Patrick Henry, 1775' he said.

    'Very good!'

    Who said 'Government of the People, by the People, for the People, shall not perish from the Earth?'

    Again, no response except from Chandrasekhar. 'Abraham Lincoln, 1863' said Chandrasekhar.

    The teacher snapped at the class, 'Class, you should be ashamed. Chandrasekhar, who is new to our country, knows more
    about its history than you do.'

    She heard a loud whisper: 'Fuck the Indians,'

    'Who said that?' she demanded. Chandrasekhar put his hand up. 'General Custer, 1862.'

    At that point, a student in the back said, 'I'm gonna puke.'

    The teacher glares around and asks 'All right! Now, who said that?'

    Now furious, another student yells, 'Oh yeah? Suck this!' Chandrasekhar jumps out of his chair waving his hand
    and shouts to the teacher , 'Bill Clinton, to Monica Lewinsky, 1997!'

    Now with almost mob hysteria someone said 'You little shit. If you say anything else, I'll kill you.'

    Chandrasekhar frantically yells at the top of his voice, Michael 'Jackson to the child witnesses testifying against him- 2004.'

    The teacher fainted..

    And as the class gathered around the teacher on the floor, someone said, 'Oh shit, we're screwed!'

    And Chandrasekhar whispered quietly, "the Republicans, November 4th, 2008".

    I though such contracts are illegal in US?....It is employment at will.....that means they can kick you out anytime or you can leave anytime....maybe someone can clarify

    I don't know if these points are written as a joke. Technically H1B's are guest workers. If there is no work, they need not be here. "...Don't send RFE to those on EAD...", seems to tell don't do your job of checking whatever you are supposed to check before admitting a new immigrant.

    Best thing is do nothing, just wait and hope for the best. Any actions are not likely to favour immigration or speedup GC granting, as these are not favoured in difficult economic times.

    I agree about your comment on guest workers. But h1bs are also human beings. Rather than treating them like car imported from Japan treat them humane. Don't just think of h1bs as a number. There is a human being behind them. Its not easy to just uproot everything you have since last 10yrs and move back to where you came. This is not a treatment for a "guest".

    Also how humane is this for a country touting horn of human rights all over the world (read Tibet/China)?

    A lot of people do different things on h1b. It is upto you to carefully report your taxes. As long as you don't get a 1099, it is at your discretion on how to report whatever money has been earned.

    The reason why h1b is not supposed to earn income from other sources is because h1b workers are supposed to work only for sponsering employers. But things like apartment referals, gift checks, stock money, etc... has nothing to do with you not working for your employer.

    Hi Everyone,

    I will be laid off from an american company by the end of Feb 2009. I spoke to my previous desi employee as my H1b with his company is still valid and he din't revoked it until now

    But he agrees to let me join his company but at the same time he worried about few things



    Q1) I was with him for 6 months of 2008 and moved to an American Company so the total pay in the W2 for year 2008 is less than LCA amount.
    Would that be a problem as i din't work with him for an entire year in which case it is bound to be less than LCA amount..
    Mind you i'm looking at the Yearly wage if you look at month wise it is much higher than mentioned in LCA.

    Would that be of any problem to both me and employeer.

    Q2) He also said that when somebody re hires any one , the employeer is liable to pay back wages for the period of time he was out.

    It sounds illogical atleast to me because he didn't terminate me from the job it was me who quit the job and transferred my H1b on a good note , but there is no official document saying i quit the job or he terminated me ....


    I would appreciate if some could throw some light on this ....

    My future is relied on these issues

    My I-485 Receipt Notice does not have any PD on it either.
